Land disputes

Written By : N Draumasei US . The discussion by the Fiji Law Society on the inclusion of legal personnel in solving land and chiefly disputes should be thoroughly looked into.
I really don’t understand why the society is saying this today – that there are provisions in the constitution to appoint a person with a legal background while they continued to sit and watch all the previous disputes in Fiji.
The recent dispute in Nakelo is a good example. The ruling made by Ratu Talemo Ratakele regarding the rightful holder of the Tui Nakelo title is like telling the people of Fiji that the distance from Nausori to Suva is minus-12 miles while we all know that distances are always positive.
There is no consistency, no logic and absolutely makes no point in trying to resolve it. A judicial review of the Tui Nakelo ruling is the next step to be taken as the NLC officials lack common sense and knowledge in my view in solving the Tui Nakelo dispute based on customary and common laws.
