State appeals ruling on retirement age

Written By : Sun Fiji Newsroom. The State’s appeal against last year’s High Court ruling that retirement age remains at 60 years was heard yesterday.
The appeal challenges the decision by Justice Filimoni Jitoko in favour of the Fiji Public Service Association where he ordered that retirement age for civil servants remain at 60 years and not 55 as was decided by the interim government.
The appeal was heard before Justice Davendra Pathik at the Fiji Court of Appeal.
State lawyer Sharvada Sharma and FPSA lawyer Hamendra Nagin made submissions before the court.
The State’s appeal is made on the grounds that the court was wrong in its finding that the Public Service Commission failed to consult unions before implementing the new retirement age.
Mr Sharvada submitted that while the retirement age policy may further a substantial objective of creating employment for the unemployed and at the same time reducing costs to government, it was neither proportionate nor rationally connected to the objectives accomplished.
Justice Pathik is expected to make a ruling on notice.
